This website is operated by MKODE SOLUTION S.R.L., a Romanian limited liability company with CUI 54031871 and Trade Register number J2026011939007, having its registered office at Bulevardul General Gheorghe Magheru 31, Biroul nr. 2, Etaj 5, 010325 Bucharest, Romania.

2. Scope and acceptance

These Terms apply to the mkodesolution.com website and to services, digital materials, or educational content purchased from us through an individual offer, invoice, order form, or payment link.

By placing an order or using purchased content, you agree to these Terms. If we sign a separate proposal, statement of work, or contract, that document prevails where it expressly differs from these Terms.

3. What we provide

Our work may include QA consulting, QA process setup and audits, product testing, software development, integrations, workflow automation, and related professional services. We may also offer digital materials or educational services through a specific offer or payment page.

The exact scope, deliverables, timetable, access period, and any customer-specific conditions are stated in the relevant proposal, contract, invoice, product description, or checkout page.

4. Orders and formation of a contract

An order is created when you accept our written offer, sign an agreement, pay an invoice, or complete the relevant checkout. A contract is formed when we confirm the order or begin performance in accordance with your request.

We may decline an order before performance where information is incomplete or inaccurate, the requested activity is unlawful, or we cannot reasonably provide the requested service. Any payment already received for a declined order will be returned.

5. Prices, taxes, invoices, and payment

Prices and the payment currency are shown in the relevant offer, invoice, or checkout. Taxes are applied where required by law. Payments may be collected by bank transfer or through Stripe and other payment providers made available at checkout.

We do not receive or store your full payment-card details. Payment providers process those details under their own terms and privacy notices. You are responsible for providing accurate billing information and for any bank or foreign-exchange charges applied by your provider.

Invoices and related documents may be issued and delivered electronically, including through our invoicing service provider.

6. Delivery and performance

Professional services are performed according to the scope and schedule agreed with you. Dates may depend on timely access, information, feedback, approvals, and other cooperation from the customer.

Digital content may be delivered by email, download link, online account, or another method described at checkout. You are responsible for providing a working email address and retaining access to delivered materials.

7. Your responsibilities

  • Provide complete, accurate, and up-to-date information required for the work or purchase.
  • Ensure that you have the right to share any systems, materials, personal data, credentials, or other information supplied to us.
  • Use the website, deliverables, and purchased content lawfully and do not attempt to compromise their security.
  • Maintain appropriate backups and security controls for your own systems and data.

8. Intellectual property

The website, brand, templates, methods, and materials made available by us remain owned by or licensed to MKODE SOLUTION S.R.L. unless a written agreement states otherwise.

Ownership and permitted use of customer-specific deliverables are governed by the applicable proposal or contract. Purchased digital or educational content is licensed for the buyer’s personal or internal business use and may not be copied, resold, published, shared, or distributed without our written permission.

9. Confidentiality

Each party should protect non-public technical, commercial, and business information received from the other and use it only for the agreed purpose. A separate non-disclosure agreement or confidentiality clause prevails where one applies.

10. Cancellations, withdrawal, and refunds

Cancellation and refund rights depend on whether you purchase as a business or consumer, the type of service or content, and whether performance has begun. The detailed rules and request process are set out in our Refund, Cancellation and Withdrawal Policy, which forms part of these Terms.

11. Warranties and liability

We perform professional services with reasonable care and skill. Unless expressly agreed, we do not guarantee that software will be free from every defect, that all risks will be identified, or that a particular commercial outcome will be achieved.

To the extent permitted by law, neither party is liable for indirect or consequential loss, lost profit, lost opportunity, or loss caused by matters outside its reasonable control. Our aggregate liability relating to a specific paid service will not exceed the fees paid for that service during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability or statutory rights that cannot legally be excluded, including liability for fraud or intentional misconduct and mandatory consumer rights.

12. Consumer rights

If you are a consumer, you retain all mandatory rights available under Romanian and European Union consumer law. This includes applicable information, conformity, remedy, and withdrawal rights. Nothing in these Terms reduces those rights.

You may also contact the Romanian National Authority for Consumer Protection (ANPC) or use another competent consumer dispute-resolution body where applicable.

13. Governing law and disputes

These Terms are governed by Romanian law. We encourage you to contact us first so that we can try to resolve any concern directly. Subject to mandatory consumer jurisdiction rules, disputes are submitted to the competent Romanian courts.

14. Changes to these Terms

We may update these Terms to reflect legal, operational, or service changes. The version published when an order is made continues to govern that order unless a change is required by law or agreed with you.
